Section 1  —  Purpose and Who Completes This Form

This Authorization must be completed by the parent or legal guardian of any participant under 18 years of age, or under the age of majority in the jurisdiction where the Activity is conducted if that age is higher (the “Minor”). In this Authorization, “I” and “my” refer to the parent or legal guardian completing it.

This Authorization is required in addition to, and does not replace, the applicable Participant Release. I must read and accept the Participant Release for the Activity, and complete this Authorization, before the Minor may participate. Terms defined in the Participant Release have the same meaning here.

THE MINOR MAY NOT PARTICIPATE UNLESS THIS AUTHORIZATION IS COMPLETED AND SIGNED BY A PARENT OR LEGAL GUARDIAN.

Section 2  —  Authority and Incorporation

I represent that I am the parent or legal guardian of the Minor and that I have the legal authority to enter into this Authorization on the Minor’s behalf and to make decisions concerning the Minor’s participation, medical care, and personal information.

I confirm that I have read and accepted the Participant Release identified in the details block at the end of this Authorization, that I have received a copy of it, and that its terms, including the release, the covenant not to sue, the indemnity, the assumption of risk, and the general provisions, are incorporated into this Authorization and apply to the Minor’s participation as fully as they apply to an adult participant.

Section 3  —  Acknowledgment and Assumption of Risk on Behalf of the Minor

I have read the assumption of risk provisions of the Participant Release in full. I understand that the Activity is dangerous and hazardous and may entail the risk of serious injury, death, and property or economic damage, and I have reviewed the specific risks listed there.

I have explained those risks to the Minor to the extent of the Minor’s understanding, and I consent to the Minor’s participation notwithstanding them. On the Minor’s behalf and on my own behalf, I assume all of those risks, whether known or unknown and whether foreseen or unforeseen.

I represent that the Minor is physically and medically fit to participate, and that the Minor is capable of meeting the physical demands of the Activity described in the Participant Release.

Section 4  —  Release on Behalf of the Minor

On behalf of the Minor and on my own behalf, and on behalf of our respective personal representatives, heirs, assigns, executors, administrators, and next of kin, I release, discharge, and forever hold harmless the Released Parties from any and all Claims arising from or in connection with the Minor’s participation in the Activity, whether or not caused or contributed to by the negligence of any of the Released Parties, to the fullest extent permitted by applicable law.

I also agree, on the Minor’s behalf and my own, to the covenant not to sue set out in the Participant Release.

Nothing in this Authorization releases any Claim arising from the gross negligence, recklessness, or willful or intentional misconduct of any Released Party, nor any Claim that applicable law does not permit to be released, waived, or limited in advance.

Section 5  —  Indemnification

To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all Claims, damages, costs, expenses, and liabilities, including reasonable attorneys’ fees and other professional fees, that are brought by or on behalf of the Minor, or that arise from the Minor’s acts, omissions, or participation, including:

• any Claim brought by the Minor after the Minor reaches the age of majority;
• any Claim brought by any other person on the Minor’s behalf, whether or not that person is bound by this Authorization; and
• any Claim, or any cost of defending any Claim, asserted on the ground that my release of the Minor’s own claims under this Authorization is unenforceable in whole or in part.

I understand and accept that this indemnity is intended to apply even where the release in the preceding Section is held ineffective as to the Minor’s own claims.

Section 6  —  Medical Treatment, Evacuation and Financial Responsibility

I authorize the Organizer and its representatives to obtain or administer for the Minor such first aid, medical treatment, transport, and emergency evacuation as they consider reasonably necessary for the Minor’s health and safety, and I consent to the Minor’s examination and treatment by licensed medical personnel, where I cannot be reached in time to give consent. This authorization is granted for the Minor’s benefit and imposes no duty on any Released Party to provide, procure, or fund medical care, rescue, or evacuation.

I am solely responsible for the cost of all medical care, transport, evacuation, and repatriation provided to the Minor, whether or not arranged by a Released Party, and I will reimburse any Released Party that advances such cost.

I acknowledge the insurance provisions of the Participant Release and confirm that I am responsible for arranging any medical, accident, travel medical, or emergency evacuation coverage for the Minor, and that no Released Party provides it. I will inform the Organizer before the Activity begins of any circumstance affecting the Minor that requires an accommodation in order for the Minor to participate safely.

Section 7  —  Supervision

I confirm that the Minor will be supervised at all times in accordance with the requirements of the Activity, and that the supervision arrangement recorded in the details block at the end of this Authorization applies. I remain responsible for the Minor’s conduct, and I acknowledge that the Organizer may remove the Minor, and may require the Minor to be accompanied or collected, without refund, where in its judgement the Minor’s participation or conduct endangers any person or breaches the rules of the Activity.

Section 8  —  Publicity and Media on Behalf of the Minor

On the Minor’s behalf and my own, I grant the Licensed Parties identified in the Participant Release the same rights in respect of the Minor’s appearance, name, likeness, voice, statements, and any photographic, video, or audio materials created by the Minor during the Activity as an adult participant grants under the publicity and media provisions of the Participant Release, on the same terms, and I waive on the Minor’s behalf and my own any right to inspect or approve their use.

Section 9  —  General Provisions

This Authorization is governed by, and shall be construed in accordance with, the governing law and forum provisions of the Participant Release, and the provisions of that Release concerning enforcement to the maximum extent permitted, reformation and severability, entire agreement, electronic acceptance and signature, binding effect, language, and privacy apply to this Authorization as though set out here in full.

My acceptance of this Authorization by electronic means, including by checking a box, clicking a button, typing my name, or submitting an electronic registration form, constitutes my signature and has the same legal effect as a handwritten signature.

If more than one parent or legal guardian has authority in respect of the Minor, I represent that I am authorized to act on behalf of the other, or that the other has also signed below.

Section 10  —  Acknowledgment and Acceptance

I HAVE READ THIS AUTHORIZATION AND THE PARTICIPANT RELEASE AND FULLY UNDERSTAND THEIR TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, BOTH MY OWN AND, TO THE EXTENT THE LAW ALLOWS, THOSE OF THE MINOR, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES FOR THEIR OWN NEGLIGENCE. I UNDERSTAND THAT I AM AGREEING TO INDEMNIFY THEM AGAINST CLAIMS BROUGHT ON THE MINOR’S BEHALF, INCLUDING CLAIMS BROUGHT AFTER THE MINOR REACHES ADULTHOOD. I UNDERSTAND THAT THE MINOR IS ASSUMING RISKS THAT MAY RESULT IN SERIOUS INJURY OR DEATH. MY ACCEPTANCE IS GIVEN FREELY AND VOLUNTARILY, WITHOUT ANY INDUCEMENT OR ASSURANCE HAVING BEEN MADE TO ME.
